1. Welcome to Vitals

These Terms of Service ("Terms") govern your access to and use of Vitals ("the Service"), a church analytics and metrics tracking platform operated at vitals.church. By accessing or using the Service, you agree to be bound by these Terms.

We've written these Terms to be as clear and fair as possible. If you have questions, please reach out to us at legal@vitals.church.

2. What Vitals Does

Vitals helps churches track, visualize, and understand their key metrics including:

  • Weekend service attendance with contextual information (weather, holidays, events)
  • Kids and student ministry check-ins with capacity tracking
  • Giving totals and trends (aggregate data, not individual donor information)
  • Digital engagement (YouTube, social media, website traffic)
  • Vitals Review for weekly service debriefs with category scorecards and team action items
  • Custom metrics unique to your church's needs

The Service integrates with third-party platforms like Planning Center to aggregate data into unified dashboards, reports, and insights.

3. Your Account

To use the Service, you must:

  • Create an account with accurate and complete information
  • Be at least 18 years of age
  • Be authorized to act on behalf of your church or organization
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorized access at security@vitals.church

You are responsible for all activities that occur under your account. We recommend enabling two-factor authentication and using role-based permissions to control team member access.

4. Acceptable Use

You agree to use the Service only for lawful purposes. You agree not to:

  • Use the Service for any unlawful purpose or to violate any laws
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service, servers, or networks
  • Share your account credentials with unauthorized parties
  • Use the Service to collect or store personal data in violation of privacy laws
  • Reverse engineer, decompile, or attempt to extract the source code
  • Use automated tools to scrape, crawl, or access the Service without permission
  • Resell or redistribute the Service without written authorization

5. Third-Party Integrations

The Service connects to third-party platforms to collect and display your data. When you enable integrations:

  • You authorize us to access data from these platforms on your behalf
  • You confirm you have the authority to grant such access
  • You understand that third-party services are governed by their own terms
  • You may disconnect integrations at any time through your settings
  • We are not responsible for the availability or accuracy of third-party services

Current integrations include Planning Center, YouTube, Google Analytics, Facebook, Instagram, and various giving platforms.

6. Your Data

You own your data. You retain full ownership of all data you input into the Service and all data retrieved from your connected third-party accounts. We claim no ownership rights over your content.

You grant us a limited license to use this data solely to:

  • Provide the Service to you
  • Display your metrics and generate reports
  • Calculate trends, comparisons, and insights
  • Improve the Service (using aggregated, anonymized data only)

You can export your data at any time in standard formats (CSV). When you cancel your account, you can download your data before deletion.

7. Subscription and Payment

Pricing

Vitals is priced at $50 per campus per month. This includes:

  • Unlimited team members
  • All features and integrations
  • Unlimited metrics and data storage
  • Weekly email reports
  • Email and chat support

Church Plants

Churches less than 2 years old qualify for our church plant program and receive Vitals completely free. Contact us to verify eligibility.

Billing Terms

  • Subscriptions automatically renew unless cancelled before the renewal date
  • You may cancel at any time; access continues until the end of your billing period
  • We offer a 30-day money-back guarantee for new subscribers
  • We reserve the right to change pricing with 30 days notice
  • Price changes do not affect your current billing period

Refunds

We offer a 30-day money-back guarantee. If you're not satisfied within the first 30 days, contact us for a full refund. After 30 days, we do not provide refunds for partial months, but you may cancel at any time.

8. Service Availability

We strive to maintain 99.9% uptime. The Service may be temporarily unavailable due to:

  • Scheduled maintenance (we'll notify you in advance when possible)
  • Emergency maintenance for security or stability
  • Third-party service outages (Planning Center, hosting providers, etc.)
  • Circumstances beyond our reasonable control

We are not liable for any loss resulting from service interruptions, though we will work diligently to restore service as quickly as possible.

9. Security

We implement enterprise-grade security measures including:

  • TLS 1.3 encryption for all data in transit
  • AES-256 encryption for all data at rest
  • SOC 2 compliant infrastructure
  • Regular security audits and penetration testing
  • Automatic daily backups with geographic redundancy
  • Role-based access control

10. Intellectual Property

The Service, including its design, features, code, and content (excluding your data), is owned by Vitals and protected by intellectual property laws.

You may not:

  • Copy, modify, or create derivative works of the Service
  • Use our trademarks, logos, or branding without written permission
  • Claim affiliation with Vitals without authorization

We grant you a limited, non-exclusive, non-transferable license to use the Service for your church's internal purposes in accordance with these Terms.

11. Limitation of Liability

To the maximum extent permitted by law, Vitals shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

  • Loss of profits, revenue, or goodwill
  • Loss of data (beyond our backup restoration capabilities)
  • Business interruption
  • Errors in third-party data sources

Our total liability for any claims arising from these Terms or your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

12. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to:

  • Warranties of merchantability
  • Fitness for a particular purpose
  • Non-infringement
  • Accuracy of data from third-party sources

We do not warrant that the Service will be uninterrupted, error-free, or completely secure.

13. Indemnification

You agree to indemnify and hold harmless Vitals and its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you provide through the Service

14. Termination

By You

You may cancel your account at any time through your account settings or by contacting us. Upon cancellation:

  • Your access continues until the end of your current billing period
  • You can export your data before the account closes
  • Your data is retained for 30 days, then permanently deleted

By Us

We may suspend or terminate your access if you:

  • Violate these Terms
  • Engage in fraudulent or abusive behavior
  • Fail to pay for the Service after reasonable notice
  • Use the Service in a way that harms other users or our infrastructure

We will provide notice and an opportunity to remedy violations where reasonable. In cases of serious violations, we may terminate immediately.

15. Changes to Terms

We may modify these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on this page
  • Updating the "Last updated" date
  • Sending an email notification for significant changes

Continued use of the Service after changes constitutes acceptance of the new Terms. If you disagree with changes, you may cancel your account.

16. Governing Law and Disputes

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.

Any disputes arising from these Terms or your use of the Service shall be resolved through good-faith negotiation. If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association.

17. Miscellaneous

  • Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and Vitals.
  • Severability: If any provision is found unenforceable, the remaining provisions continue in effect.
  • Waiver: Our failure to enforce any right does not waive that right.
  • Assignment: You may not assign your rights under these Terms without our consent. We may assign our rights to a successor.
  • Force Majeure: We are not liable for delays or failures due to circumstances beyond our reasonable control.
